Domestic Violence (KDRT)

Domestic violence (Kekerasan Dalam Rumah Tangga or KDRT) is a serious form of violence that may occur within a household or family relationship.

Cases of domestic violence disproportionately involve women as victims. Domestic violence is closely associated with gender-related issues, discrimination against women, and the perception that violence within a family is merely a private matter.

Domestic violence committed by a husband against his wife is not limited to physical abuse. It may also involve psychological, economic, and sexual violence.

Under Indonesian criminal law, criminal acts involving violence or threats of violence may affect anyone, regardless of gender or age, including children and adults.

Forms of Violence Against Family Members

Based on cases that have occurred in Indonesia, violence within the household can generally be categorized into the following forms:

1. Physical Violence
Physical violence may include :

  • Killing

  • Physical assault or abuse

  • Rape

2. Psychological, Emotional, or Non-Physical Violence
Psychological or emotional violence may include:

  • Insults and humiliation

  • Comments intended to demean or undermine the victim's dignity and self-esteem

  • Preventing a wife from socializing or maintaining relationships with others

  • Threatening to send the wife back to her parents

  • Threatening divorce

  • Threatening to separate the wife from her children

3. Sexual Violence
Sexual violence may include:

  • Depriving a wife of her sexual or intimate needs as a means of control

  • Forcing sexual activity or practices that the wife does not want or has not consented to

  • Forcing sexual intercourse when the wife does not consent, including when she is ill or menstruating

  • Forcing a wife into prostitution or other forms of sexual exploitation

4. Economic Violence
Economic violence may include:

  • Failing to provide financial support for a wife

  • Exploiting a wife's financial dependence in order to control her life

  • Allowing a wife to work while subsequently taking control of or withholding her income

Forms of Domestic Violence Under Indonesian Law

Under Law No. 23 of 2004 concerning the Elimination of Domestic Violence, the legislation is intended to:

  1. Prevent all forms of domestic violence;

  2. Protect victims of domestic violence;

  3. Take legal action against perpetrators of domestic violence; and

  4. Preserve harmonious and prosperous family relationships.

In addition to criminal penalties, a judge may impose additional measures on a perpetrator, including:

a. Restrictions on the Perpetrator's Movement

The court may restrict the perpetrator's movement, including measures intended to keep the perpetrator away from the victim for a specified distance and period, as well as restrictions on certain rights of the perpetrator.

b. Mandatory Counseling

The court may require the perpetrator to participate in a counseling program under the supervision of a designated institution.

Protection Orders for Victims of Domestic Violence

Article 29 of Law No. 23 of 2004 concerning the Elimination of Domestic Violence provides for applications for a protection order.

An application for a protection order may be submitted by:

  • The victim;

  • The victim's family;

  • A friend of the victim;

  • The police;

  • A volunteer assisting the victim; or

  • A religious counselor or spiritual advisor.

A protection order is intended to provide legal protection for victims and help prevent further acts of domestic violence.
